Terms and Conditions

Welcome to Player 3, a platform that empowers independent game developers to monetize their work, share content, and build communities.
By accessing or using Player 3 ("the platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform

1. User Eligibility

You must be at least 13 years old to use Player 3. If you are under 18, you may only use the Platform under the supervision of a parent or guardian

2. Monetization and Fee

Player 3 allows developers to earn money through memberships and donations.

• The platform takes a 10% fee on all membership transactions. This does not include additional transaction or payment processing fees, which may be charged by third-party providers (e.g., Stripe).
• For donations, Player 3 charges a reduced 5% fee, also excluding third-party transaction fees.
• Player 3 issues payouts through Stripe on the 15th of each month for available earnings.
  Payout timing may vary due to Stripe processing, bank delays, or account verification. It is the creator’s responsibility to ensure their Stripe account is connected and active. Player 3 is not liable for delays caused by third-party providers.

3. Refund Policy

All purchases on Player 3 — including memberships, donations, and any other payments — are final.
NO REFUNDS. NO EXCEPTIONS.
Users are responsible for managing their subscriptions or support. We encourage supporters to review creator content before making any financial contribution.

4. Content and Conduct

You may post text, images, video embeds, and other media (“Bits”). You are solely responsible for content you upload or publish. The following content and conduct are prohibited:

• Illegal content or activity; intellectual property infringement; unauthorized use of others’ assets.
• Malware, viruses, trojans, or any harmful code; attempts to bypass security or scanning.
• Hate speech, harassment, threats, or incitement to violence.
• Pornographic or sexually explicit material; sexualization of minors (zero tolerance).
• DoXXing or disclosure of personal data without consent.
• Scams, fraud, or deceptive practices (including fake giveaways or misrepresented campaigns).
• Extremist, terrorist, or violent extremist propaganda.

Player 3 may remove content, restrict features, or suspend/terminate accounts at our discretion to protect users and the Platform.

5. File Upload Agreement (Required Consent)

When you upload any file (including games, builds, assets, videos, images, audio, or code), you agree to all of the following:

5.1 Ownership & Rights

• You own the content you upload or have all necessary rights, licenses, and permissions to upload, display, and distribute it on the Platform.
• Uploading does not transfer ownership to Player 3. You grant Player 3 a limited, worldwide, non-exclusive, royalty-free license to host, cache, store, reproduce, transcode, display, and distribute your content solely to operate the Platform and deliver features you use (e.g., streaming, embeds, sharing, backups, and security scanning).

5.2 Security & Scanning Consent

• You consent to automatic security scanning of all uploaded files for malware, exploits, prohibited content, and policy violations.
• Scanning may include hashing, pattern checks, and sandbox analysis. Files that fail scanning may be blocked, quarantined, or deleted, and related accounts may be restricted.
• We store user-uploaded content on our servers to provide the Platform. Files are not made public unless you publish them. We do not sell your files or personal data. We may share data only with service providers acting as our processors (e.g., storage, security, analytics, payments) under appropriate agreements.

5.3 Accuracy & Labels

• Your titles, descriptions, and tags must be accurate and non-misleading.
• If your content includes third-party materials (e.g., licensed music, fonts, or engines), you must have the right to use them and comply with their licenses.

5.4 Technical Limits

• You agree to respect size, bandwidth, and rate limits. We may throttle or restrict uploads that degrade service for others.
• Do not attempt to circumvent storage limits, scanning, or moderation systems.

6. Prohibited & Restricted Uploads (Including AI-Generated)

To protect creators, players, and the integrity of the Platform, the following are not allowed to be uploaded or distributed on Player 3:

6.1 AI-Generated Projects and Assets (Prohibited)

• Fully or partially AI-generated projects or assets are not permitted, including but not limited to: game code, levels, maps, art, textures, models, animations, VFX, music, SFX, voice, scripts, story text, or marketing assets produced by generative systems (e.g., LLMs, image/audio generators).
• AI-assisted content that meaningfully contributes generative output (beyond standard, non-generative tooling like code autocompletion, linters, or compilers) is considered AI-generated and is prohibited.
• If Player 3 publishes an exception policy in the future (e.g., explicitly labeled and verified AI use), only then will limited AI content be allowed under those rules.

6.2 Other Forbidden Uploads

• Stolen, ripped, or unauthorized ports, ROMs, decompiled content, or keys.
• Infringing or license-violating uses (including unlicensed engines, asset packs, or music).
• Malicious files, hidden miners, spyware, or obfuscated payloads.
• NSFW/explicit sexual content or content involving minors (zero tolerance).
• Cheats that harm multiplayer experiences, bots designed to exploit other services, or tools intended to enable fraud.

6.3 Enforcement

• Violations may result in immediate removal, feature limits, account suspension/termination, forfeiture of payouts related to the offending content, and/or reporting to relevant authorities where required by law.

7. Creator Responsibility

Creators are responsible for:

• Fulfilling promised benefits tied to memberships.
• Accurately representing content and offerings.
• Managing their tax obligations and compliance with applicable laws.
• Requesting data deletion by contacting us (subject to legal/operational retention needs).

Player 3 is not liable for disputes between users and creators.

8. Username and Profile URL Policy

Player 3 may modify, reclaim, or restrict any username or profile URL if we believe it infringes a third party’s rights (e.g., trademarks, business names). We may alter the URL, disable the profile, or request a change to avoid confusion or legal conflict.

9. Account Termination

We may suspend or terminate any account at our discretion for violations of these Terms or behavior that undermines the safety or integrity of the Platform.

10. Intellectual Property & Takedowns

If you believe content infringes your rights, contact us with a detailed notice (links, proof of ownership, and your contact info). We may remove content, restrict accounts, and, where appropriate, forward notices to the uploader. Repeat infringement may result in termination.

11. Privacy

Use of the Platform is also governed by our Privacy Policy. By using Player 3, you consent to processing consistent with that policy, including storage of uploads to operate the Platform and automated scanning for abuse prevention and security.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of those changes.
